Spouses discharging each others Zakaat

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: Me and my wife both are working and our assets are common e.g. we purchased property/Gold from common funds and we do not remember who paid more or less but we both are eligible to pay zakaat. So my question is in the above situation shall we calculate zakaat together or not. In the past we paid the zakaat together even though we didn’t know if it is correct or not. Please guide accordingly.

A: If you’ll agree that the gold, silver and zakaatable assets are owned jointly between yourselves e.g. each one owns 50%, then when discharging the zakaat, each one of you should discharge the zakaat of his portion. However, if one spouse discharges his zakaat as well as the zakaat of the other spouse, it will be permissible provided it is done with their consent.

And Allah Ta’ala (الله تعالى) knows best.
