Husband and wife jointly purchasing a sewing machine

Q: My father had bought a sewing machine for me. It cost R1000. I used it to sew clothes for my family. After a few years it needed repairs and they adviced I trade it in for another machine as it was going to cost alot to repair the machine. Hence, I traded it in for another machine. They gave me R500 for my machine. The new machine cost R5500. My husband paid in the balance. Can you advice who does the machine belong to?

A: Since your money and your husbands money was jointly used to purchase the machine, it will belong to both of you proportionately. However if you husband bought it for you and gifts his portion to you, then it will belong to you.

And Allah Ta’ala (الله تعالى) knows best.
