Marital problems and custody of children

Q: I am seriously contemplating a divorce as I am no longer interested in the marriage, it has had a major share of issues and I have also been advised to let go. The worst part is that everybody from my family knows my husband to be a liar and although he is an Aalim, the behavior which he has shown to a prominent Aalim is disgusting. The only problem that I have is my 2 kids. I will look after them, but I’m worried about their future. Please advise as its hard for children that have a broken home.

A: After divorce, the wife gets custody of the children. In the case of a girl, the mother gets custody till the age of nine. In the case of a boy, the mother gets custody till the age of seven. Thereafter, the father will get the custody of the children.

Refer to an old senior Aalim who handles marital problems for advice regarding your condition.

( والحاضنة ) أما أو غيرها ( أحق به ) أي بالغلام حتى يستغني عن النساء وقدر بسبع وبه يفتى لأنه الغالب … ( والأم والجدة ) لأم أو لأب ( أحق بها ) بالصغيرة ( حتى تحيض ) أي تبلغ في ظاهر الرواية … ( وغيرهما أحق بها حتى تشتهي ) وقدر بتسع وبه يفتى … ( وعن محمد أن الحكم في الأم والجدة كذلك ) وبه يفتى لكثرة الفساد زيلعي

و قال في الشامية : قوله ( في ظاهر الرواية ) مقابله رواية محمد الآتية, قوله ( وبه يفتى ) قال في البحر بعد نقل تصحيحه ولحاصل أن الفتوى على خلاف ظاهر الرواية ( رد المحتار 3/566)
