Q: As part of our marketing campaign towards promoting some of our products we are looking at having a competition whereby the participant will have to answer successfully some questions to be entered into a draw for some prices.
Normally, in the past the entries would be sent to us by post. We are looking at adding another dimension in which the entries can be sent to us by SMS. They will not be any additional charge for submitting the entry nor is there any entry fee. The only charge will be the standard SMS charge that is payable to the phone company. The same way that, when they were sending entries by post they would purchase and Stamp, envelope etc, in this case they will be paying the SMS charge to send their entry. Would this be acceptable?
A: It is acceptable.
وإنما يجوز ذلك إن كان البدل معلوما في جانب واحد بأن قال إن سبقتني فلك كذا وإن سبقتك لا شيء لي عليك أو على القلب أما إذا كان البدل من الجانبين فهو قمار حرام الخ (الفتاوى الهندية 5/324)
( حل الجعل ) … ( إن شرط لمال ) في المسابقة ( من جانب واحد وحرم لو شرط ) فيها ( من الجانبين ) لأنه يصير قمارا الخ
و في رد المحتار : قوله ( لأنه يصير قمارا ) لأن القمار من القمر الذي يزداد تارة وينقص أخرى وسمي القمار قمارا لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه ويجوز أن يستفيد مال صاحبه وهو حرام بالنص ولا كذلك إذا شرط من جانب واحد لأن الزيادة والنقصان لا تمكن فيهما بل في أحدهما تمكن الزيادة وفي الآخر الانتقاص فقط فلا تكون مقامرة لأنها مفاعلة منه زيلعي (رد المحتار 6/402)
