Musaafir mistakenly performing four rakaats instead of two

Q:

1. A musaafir read four rakaats salaah unknowningly and after a couple of days he corrected it to two rakaats. Will his salaah be valid?

2. A musaafir read two rakaats but someone told him to read 4 rakaats and due to confusion, he reads four rakaats. Does the first salaah count and will the second salaah which was read as four rakats be regarded as nafl? 

Bismillaah

A:

1. The salaah is valid. The sharee ruling is that if a musaafir had performed four rakaats instead of two rakaats, if he realises his mistake during the salaah time, he should repeat the salaah. However, after the salaah time passes, the salaah will not have to be repeated.

2. The first salaah will be fardh and the second salaah will be nafil.

And Allah Ta’ala (الله تعالى) knows best.

(ولزم نفل شرع فيه) بتكبيرة الإحرام أو بقيام الثالثة شروعا صحيحا (قصدا)إلا إذا شرع متنفلا خلف مفترض ثم قطعه واقتدى ناويا ذلك الفرض بعد تذكره، أو تطوعا آخر، أو في صلاة ظان، أو أمي، أو امرأة، أو محدث يعني وأفسده في الحال؛ أما لو اختار المضي ثم أفسده لزمه القضاء (ولو عند غروب وطلوع واستواء) على الظاهر

قال الشامي: قال في المنح: واحترز بقوله قصدا عن الشروع ظنا، كما إذا ظن أنه لم يصل فرضا فشرع فيه فتذكر أنه قد صلاه صار ما شرع فيه نفلا لا يجب إتمامه حتى لو نقضه لا يجب القضاء. (رد المحتار 2/30)
