Can My Husband Revoke Our Secret Divorce During Iddah Without Witnesses?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: If my husband has divorced me for the first time and we did not inform anyone or the court. Can he revoke it during iddah without any eyewitness?

Bismillaah

A: If he gave you one raji talaaq (one revocable talaaq) he can revoke the talaaq during the iddat period and take you back in his nikaah. Though the talaaq will be revoked, however it will be counted and he will only have two talaaq’s remaining. If he does not revoke the talaaq during the iddat period and the iddat period passes, he will no longer be able to revoke the talaaq. However, if you both wish to reunite, then a new nikaah will have to be performed with a separate mahar.

And Allah Ta’ala (الله تعالى) knows best.
