The stipulated shares of inheritance

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: We are thee brothers and sisters. I want to know that it is permissible to distribute wealth of my father in any proportion if we all three agree on that? Or we have to follow Quranic proportion of inheritance?

Bismillaah

A:

1. No, it is not permissible.

2. The shares of inheritance have been stipulated by Shari’ah. It is not permissible for anyone to make any changes in the stipulation of Shari’ah.

And Allah Ta’ala (الله تعالى) knows best.
