Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

DEAR HAZRAT

ASSALAMUALAIKUM WA RAHMATULLAHI WA BARAKATUHU

MY SON ASK ME THE QUESTION , WHO IS JOHN THE BAPTIST? THERE AFTER USING A SWEAR WORD.

HE HAD NO IDEA THAT IT IS SAYYIDUNA YAHYA [A.S].  HE TENDS TO SWEAR AT OTHER RELIGIONS.

DID HE COMMIT A SIN?

WASSALAAM

Answer:

In every condition, a person should not swear at anyone. Since your son did not use the swear word knowing that he is a Nabi (AS), his Imaan and Nikah (marriage) will not be nullified and also he will not have to give any Kaffaarah. The sin of swearing a Nabi will not fall upon him. However, since a swear word was used; he will have to seek repentance and be more careful in the future.

And Allah Ta’ala knows best
