Sub letting on a higher price

Answered as per Hanafi Fiqh by Darulihsan.com

Q: I am presently renting my business premises. My lease allows me to sub-let. My landlord has also given me verbal permission to sub divide and sub-let at a price higher than what I am being charged. Is this permissisble, if Yes, are there any conditions that I need to be aware of.

A:

The Jurists have mentioned that if some type of additions are made (even if it be minor), it will be permissible to sub-let the property at a higher price.

Since you will be sub-dividing the premises (i.e making some additions to the property), it will be permissible for you to sub-let the property at a higher price.
