How to divide the property left by a deceased father among the mother, two sons, and one son-in-law as per Shariyat?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My marhoom father has left 1 property [ built house ].Please guide how to divide this property among MOTHER – TWO SONS – AND [1]ONE SON-IN-LAW of DEAD DAUGHTER as per SHARIYAT.

Answer

(Fatwa: 56/56=D/1429)

If your father died when his parents (your grandparent) and his daughter were no longer alive, only his wife and two sons were alive then after paying the due rights preceding inheritance, all his property (including cash etc) will be distributed in 16 shares, out of which the wife will get 2 shares while each son will receive 7 shares. The son-in-law (husband of dead daughter) shall not have any share in the property.

Note: If any of your grandparents was alive at the time of death of your father or your sister (his daughter) was alive, then you should write the question again describing it in detail and consider the abovementioned distribution as null.
