Does he have the right to give his property to one bhatiji as per Shariah?

my paternal uncle is issue less.his wife has expired.he has got four bhatija & two bhatiji.he wants to give his whole property to his one bhatiji.has he got the right to give it to one bhatiji as per shariah.

Answer

(Fatwa: 524/444/B=1431)

Equal shares should be given to all four bhatija (nephews) provided all these four bhatijas are his legal heirs after his death. It is sin to give one heir by depriving the others without any valid reason. It is mentioned in hadith that one who deprives an heir without a valid reason; Almighty Allah would deprive him from Jannah on the Day of Judgment.

If anyone from the brother or parents and children of your paternal uncle (mamu) is alive ask the question again by writing the details thereof.
