Question regarding divorce

I wanted to ask you a question regarding divorce. basically what happened was me and my husband was 

arguing, he was telling me off and he put my number on reject on his phone, i said to him ;why do you have 

my number on reject' he replied'if you have a problem with me putting you on reject then consider it a divorce 

from my side, it is upto you' , then we was quiet, then my husband said 'i have given you a condition now' 

i hanged up, then my husband said 'to be on the safe side dont call or text me, until i come home and dont 

chat s*** about me putting you on reject' , something along them lines. i was revising for exam so continued

for few seconds still crying, and i remembered my husband has to put money into my account, 

i thought for a second i will ask my brother but said no and called him said, it went reject, 

i texted and emailed him to put money in my account as a reminder. he called me back and said

'what you doing, dont you take me seriously' i said 'i do, i dont have a problem you putting me on reject'

he said 'okay be a good girl now, until i come home', i said 'ok' and i hanged up.

i emailed him if you handed me the divorce then i am your wife and we are not divorced, i dont want you

to divorce me, he emailed back ok. during that time i stayed in the room trying to look for an answer 

and also revising at the same time. he come home around 420pm ish, bought me food,

said we are okay but i am emailing now because we are not sure about this. he went back 

out again around 6ish. please brother find a solution for us if there is one. this is the last divorce 

we was holding onto. jazakAllah khair for your time and help brother. it is greatly appreciated.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Your husband stated,

If you have a problem with me putting you on reject then consider it a divorce from my side, it is upto you”

You later stated,

“ I dont have a problem you putting me on reject”

Accordingly the divorce did not take place. [1] Also, what did you mean by “this is the last divorce we was holding onto” please clarify.

[1]   قَالَ وَتَعْلِيق الطَّلَاق على شَيْء فِي قلب الْمَرْأَة على سِتَّة اوجه احدها ان يَقُول انت طَالِق ان شِئْت وَالثَّانِي ان يَقُول انت طَالِق ان أردْت الثَّالِث ان يَقُول انت طَالِق ان هويت وَالرَّابِع ان يَقُول انت طَالِق ان تمنيت وَالْخَامِس ان يَقُول انت طَالِق ان رضيت وَالسَّادِس ان يَقُول انت طَالِق إِن احببت وَحكم هَذِه الاشياء كلهَا مَا تجيب بلسانها دون مَا تخفي فِي ضميرها  [النتف في الفتاوى ج 1 ص 358 ]

(قال) رجل قال لامرأته إن شئت فأنت طالق فذلك إليها مادام في مجلسها لأنه علق الوقوع بمشيئتها وذلك من عمل قلبها بمنزلة اختيارها وقد اتفقت الصحابة – رضوان الله عليهم – أن للمخيرة الخيار مادام في مجلسها فكذلك يثبت هذا الحكم فيما هو في معناه وهو المشيئة [ المبسوط السرخسي ج 6 ص 197] 

لأن من التعليقات ما يقتصر على وجود الشرط في المجلس كقوله لها أنت طالق إن شئت يقتصر على وجود المشيئة في المجلس  [ المبسوط السرخسي ج 5 ص 19]

إذا قال لامرأته: أنت طالق إن شئت، فذلك إليها ما دامت في مجلسها فإن شاءت في مجلسها وقع الطلاق

 [المحيط البرهاني في الفقه النعماني  ج 3  ص  264]

وفي الجامع أنت طالق إن شئت أو أحببت أو هويت ليس بيمين لأنه تمليك معنى تعليق صورة ولهذا يقتصر على المجلس والعبرة للمعنى دون الصورة [ردالمحتار ج 3 ص 336 سعيد]
