Has divorce taken place?

My husband had previously given me two divorces. The other day, someone told him that I went out with my cousins without his knowing. He said to me, “if this is true that you went out with them, consider it a divorce”. And I DID go out with them. So now, are we divorced?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

At the onset, we condemn any irresponsible and unwarranted statements of divorce. There are many effective mechanisms to resolve marital disputes. The statement in reference is a conditional divorce 1. Since you went out with your cousins, the condition of divorce has taken place, and that constitutes a third divorce which is a talaq-mugallazah (a permanently irrevocable divorce) 2. Your nikah has terminated. You cannot live as husband and wife.

1بدائع الصنائع – ث 3/ 30

فَحُكْمُهَا وَاحِدٌ وهو وُقُوعُ الطَّلَاقِ أو الْعَتَاقِ الْمُعَلَّقِ عِنْدَ وُجُودِ الشَّرْطِ

و أذا أضافه ألي شرط ، وقع عقيب الشرط

وإذا أضافه إلى شرط وقع عقيب الشرط مثل أن يقول لامرأته: إن دخلت الدار فأنت طالق، وهذا بالاتفاق ٢٢٨

وإن كان الطلاق ثلاثا في الحرة أو ثنتين في الأمة لم تحل له حتى تنكح زوجا غيره نكاحا صحيحا ويدخل بها ثم يطلقها أو يموت عنها
