Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Dear Brother,

In principle, if the husband uses ambiguous words to issue divorce then the divorce will depend on his intention.

“bas mein tumey chorta hoon” are ambiguous words. Therefore, if your husband had intention to issue divorce, then one irrevocable divorce will occur.

Your husband denies the issuance of divorce; hence his intention is clear that he had no intention to give talaq. Therefore, your marriage is intact.

قوله (والضرب الثاني الكنايات لا يقع بها الطلاق إلا بنية أو دلالة حال) ؛ لأنها تحتمل الطلاق وغيره فلا بد من النية أو الدلالة
