Assalaamu alaykum. I have read the rulings regarding wearing & selling of silk ties, but if a silk tie was bought in error by a muslim and cannot be returned, is it permissible to give it away as a gift to a non-muslim?
Walaikum assalam wa rahmatullah,
I pray that this finds you well, and in the best of health and spirits. May Allah grant you all good and success in this life and the next.
The general fiqh principle is that something impermissible to use oneself is impermissible to give to another (even if they are non-Muslim). [Ibn Abidin, Radd al-Muhtar; Majalla]
However, if the item isn’t obviously harmful, there is no harm in letting the non-Muslim take it, without actively giving it to them.
And Allah alone gives success.
