It is stated that there is a mosque which is surrounded by qabrastan and duly mentioned in revenue record. The land over which qabrastan is existing is also duly notified as Wakf and maintained by a committee constituted by Wakf Board. So there is no doubt over the title of entire land including the mosque i.e. the same belongs to Wakf. Now our question is whether any expansion of mosque over the surrounding land which is a qabrastan without the permission of Wakf Board or the Managing Committee be justified. Can that expanded portion be treated as part of mosque for the purpose of offering prayer or doing all related religious Islamic rituals?

In the question mentioned if the mosque is congested and an expansion is inevitable and there are no new graves around the mosque then the expansion may be carried out with the permission of the Board or Managing Committee. There might arise problems in expansion without permission. The extended portion shall be treated as mosque.
