Can I claim rights to my father’s flat as a daughter under Shariat law?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I am one sister and have two brothers, both NRIs.my father has a huge flat in the most upcoming localities of Mumbai. It was paid in terms of ‘pagdi’,where my father had paid a handsome amount and my father had been paying rent as my brothers were NRIs.After my fathers death my brothers say i have no right on it as a daughter as the house was rental. The market value of the house is in crores.Kindly enlighten me on this issue as per the shariat law.

Answer

(Fatwa: 593/593/M=1432)

If the said flat was the property of deceased father, then both the brothers and sister shall have their shares in it. The brothers are wrong who said to their sisters that they had no right. And, if the house was on rent and was not the property of the deceased father, then no one amongst the brothers and sister will have any share in it.
