It isn`t Permissible to Abort Pregnancy Resulting from Unregistered Marriage

After getting a final divorce, I married another man, but didn`t register that marriage in Islamic court, nor told my father about it. Now, I`m forty days pregnant. Is it permissible for me to abort this fetus because my husband doesn`t want it?

Answer:

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon Prophet Mohammad and upon all his family and companions.

It isn`t permissible to abort a fetus except when it jeopardizes the mother`s life and in case of special medical condition. Based on the above question, medically speaking, the mother`s life isn`t in danger. Therefore, it isn`t permissible to abort this fetus and We (Iftaa` Department) advise the asker to register her marriage in Islamic court after getting the approval of her guardian to preserve her rights and those of her baby`s. And Allah the Almighty knows best.
