Divorce and Dowry

Divorce and Dowry

By Mufti Ebrahim Desai

Q.) An acquaintance of mine divorced his wife upon her insistence. Her family is now demanding the agreed upon Mehr. Is my friend obliged to give his former wife her Mehr given that he divorced her only because she insisted that he do so? Also, would the Islamic ruling in this situation differ depending on whether or not the marriage was consummated?

A.) Mehr (dowry) is the right of the wife even after divorce. If the marriage was consummated, she is entitled to the full-stipulated amount. If the marriage was not consummated, the wife will be entitled to half the stipulated amount. It is compulsory for your acquaintance to pay his divorcee her due mehr. And Allah Ta`ala Knows Best.
