How much must I pay for a late payment?

If a person took a tuition course in 2007 and did not pay the fees (at that time, Rs 5000) and now he repents his act and wants to pay back to that oganisation. Is he suppose to pay pay the same amount (5000/-) or should the inflation be accounted for as well? Is the person liable to pay exactly 5000 or he should add the extra amount in it to cover economic inflation and pay more than 5000?

Answer

In the Name of Allah, the Most Gracious, The Most Merciful.

As-salaamu `alaykum wa-ramatullahi wa-barakatuh.

The person is obliged to pay the exact tuition fees of Rs 5000.[1] If he wishes to pay an additional amount in consideration of his delayed payment and without any demand of additional payment from the Organisation, he may do so. That will be an expression of goodwill from his side.[2]

حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ، قَالَ: اسْتَسْلَفَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بَكْرًا ، فَجَاءَتْهُ إِبِلٌ مِنَ الصَّدَقَةِ، فَأَمَرَنِي أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ، فَقُلْتُ: لَمْ أَجِدْ فِي الْإِبِلِ إِلَّا جَمَلًا خِيَارًا رَبَاعِيًا، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَعْطِهِ إِيَّاهُ، فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً»
