Is it halal to invest in such business?

Assalamu Alaikkum

Am interested in investing in a private business as a capital partner.And if the working partner indulges in any wrongdoings like Bribing, Not giving good quality, cheating customers, etc. but the business itself is a halal one

Is it still halal to invest in that business.


Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If you are the sole capital provider and your partner is the working partner, that partnership is called Mudarabah.1 In any partnership business, partners are Wakeels(representatives) and Ameens(entrusted persons) for each other. Every action will be attributed to all the partners. If you are aware that the partner is committing wrong in the business, then that wrong will be attributed to you as well. You should therefore object to the wrong practices of bribery, cheating etc. in the business and use your influence as a partner to stop the wrong practices. You cannot enter into a partnership with a person if you know that he will be committing wrong in the business practise.
