Q: Is the first talaq considered void if rujoo is done afterwards and the gap between the second talaq is 28 year. Someone told me there is a fatwa that if the second divorce is given after 25 years of the first one, then the first divorce is void?
A: This is incorrect. If one had issued the second divorce, then in total two divorces have fallen.
And Allah Ta’ala (الله تعالى) knows best.
الطَّلـٰقُ مَرَّتانِ فَإِمساكٌ بِمَعروفٍ أَو تَسريحٌ بِإِحسـٰنٍ وَلا يَحِلُّ لَكُم أَن تَأخُذوا مِمّا ءاتَيتُموهُنَّ شَيـًٔا إِلّا أَن يَخافا أَلّا يُقيما حُدودَ اللَّـهِ فَإِن خِفتُم أَلّا يُقيما حُدودَ اللَّـهِ فَلا جُناحَ عَلَيهِما فيمَا افتَدَت بِهِ تِلكَ حُدودُ اللَّـهِ فَلا تَعتَدوها وَمَن يَتَعَدَّ حُدودَ اللَّـهِ فَأُولـٰئِكَ هُمُ الظّـٰلِمونَ ﴿٢٢٩﴾ فَإِن طَلَّقَها فَلا تَحِلُّ لَهُ مِن بَعدُ حَتّىٰ تَنكِحَ زَوجًا غَيرَهُ فَإِن طَلَّقَها فَلا جُناحَ عَلَيهِما أَن يَتَراجَعا إِن ظَنّا أَن يُقيما حُدودَ اللَّـهِ وَتِلكَ حُدودُ اللَّـهِ يُبَيِّنُها لِقَومٍ يَعلَمونَ ﴿٢٣٠﴾ ﴿البقرة﴾
