Is a talaq valid if there’s no witness and audio evidence of it being said in June 2011?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My husband yesterday told me that he told me talaq thrice in the month of June 2011. He is lying. He has not told anything like that. I have an audio tape in which he is telling me to agree for a mutual separation in the month of September. There is also no witness present. Can this be considered as a valid talaq?

Answer

(Fatwa: 273/156/H=1433)

As talaq takes place by giving, in the same way it also takes place if husband admits it, though the sentence is false. Thus in the question mentioned above, though there is no witness then also talaq mughallazah took place.
