Please answer these questions: 1) before the mother of my mother she told me that i am asking your dad ot purchase one house for your sister and she said after we passes from this world this room which are presently residing will be yours 2) my father purchased a room for her after my mothers death. 3) my father had invested 45000/- in one house which i got from mhada scheme. And on selling that room for 2,65,000/- i purchased on room for about 4,30,000/- and i paid the rest amount with my earnings. The room is on my name. Does my sister have any right on these two rooms which is of my mothers property and my earnings?

Answer

(Fatwa: 2111/3810=B/1429)

(1) By saying this, no ruling will be applied.

(2) Did you give the room in your sister’s possession after purchasing it and did you declare not to have possession of it? If you have done it, are there two trusted witnesses over it? Please, explain.

(3) Your real sister will have her share in the house of the father which you had sold in 265000 rupees. However, you are the sole owner of the room you had bought at 430000 rupees with your own money, and it will not be counted the property of your father; your sister will have no share in it.
