I plan to buy a house. My mother wants to register under her name. Because she is afraid about the future in old age and if she has any propery people will care about her in her old age

However she promise to give back the property after she die. I’ve brothers too. Now waht is shariat rooling regarding the property give back to me. Can she give me the property back to me or she has to devide according to shariat? This is my first house I’m going to buy. What should be done? Can I register to my mother name or I’ve register under my name?

Answer

It is permissible for you to put the house on your mother’s name because of
security reasons. However, if you purchased the house, it belongs to you.
Therefore, after your mother passes away, the house shall return to you
alone, not to your brothers.

We suggest this agreement between you and your mother be brought to the
notice of your brothers or any potential heir and be reduced to writing by
them as well to avoid any future problems.
