Partners in a cow for Qurbaani

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: We are five brothers. We have bought one Cow. We have paid as per our financial strength for this cow. Suppose my elder brother gave 5000 and I gave 3000 and so on because we are brothers. We have divided our meat equally into 5 equal portions. Please advise is it OK or not?

Bismillaah

A: It is a prerequisite for the validity of the qurbaani that one specifies the number of shares he is purchasing in the animal. Thereafter the meat should be divided according to the stipulated shares in the cow i.e. if one brother owns 2 shares, then proportionately he will receive from the meat. It is impermissible for any shareholder to take more than his share even though he is permitted to do so. However, if all the shareholders are pleased to distribute the meat equally among themselves, then the manner in order to make it permissible is that the trotters, skin, tripe or head are joined to the meat then an equal distribution of the meat will not be necessary.
