Can I convince my brothers to build a mosque with my father’s 14,00,000 account balance?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
We are 3 brothers and 4 sisters my mother and father are expired. When my father expired he distributed his property with Shariah but he had 14,00,000 amount in his account which he had kept to built a mosque, as I am the elder son he had told me personally to build mosque with that money when he expired. Now I have convinced my sisters to build that mosque but my brothers are not agreeing to it and want to distribute the money according to Shariah. Please help me out with this.

Answer

(Fatwa: 1732/1393/B=1433)

In the question mentioned above, his statement about the construction of a mosque is a will which will be executed in one third property. If he has no wealth except this amount then as per his will one third amount shall be taken away for the construction of the mosque and the remaining amount shall be divided into 10 shares; out of which 2-2 shares shall go to the brothers and 1-1 share to the sisters.
