Dealing with Someone Who’s Wealth is Unlawful

Answered as per Shafi'i Fiqh by Shafiifiqh.com

Question:

As salamu alaykum. I would like to know what is the rule about the unlawful money, can you explain that to me inch’Allah? I am a member of an association and we are ignorant about that. We think that the unlawful money (made from alcohol or anything else which is haram) can’t be accepted by us when someone wants to give us money and we know that he made his money from haram business. Is it right? Inch’Allah can you clarify the rules about haram and halal money please? BarakAllahu’fik. Wa’salam.

Answer:

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

Imam Ghazzali maintained that it is unlawful to deal with a person whom it is known that most of his wealth comes from an unlawful source. Yet, this view has been deemed anomalous. The relied-upon view comes in Sharh al-Muhadhdhab v. 9, p. 345 and Rawdat al-Talibin v. 7, p. 337, that it is disliked to deal with a person whom it is known that most of his wealth comes from an unlawful source: the degree of dislike depending on how much doubt there is in the wealth. If one knows, with certainty, that the wealth is from an unlawful source, then it is unlawful. Ibn Hajar al-Haytami discussed this in Tuhfah v. 7, p. 180.

And Allah knows best.
