Mistake in sale

Answered as per Shafi'i Fiqh by Seekersguidance.org

Question: I ordered something online, and something else that is worth more was delivered to me. What should I do?

Answer:

Wa alaykum assalam wa rahmatullahi wa barakatuh,

Dear questioner,

Thank you for your important question.

By default, if what was delivered was other than what you ordered, then it should be returned. If you cannot find the original seller, then in principle, it should just remain with you as trust a (wadia) until you can find them.

Practically speaking, if the difference in value is very insignificant, and you are confident that the seller would not mind, you can keep the item for your own use.

I pray this helps.
