Travelling safr distance without the intention of safr

Q: If a person intended to travel from his hometown to a specific town. However he did not make intention of safr when he left. When he arrives at this town he notices that he had exceeded the safr distance. Would he be a musaafir?

A: If the distance between his town and the town he intended going to is the distance of safr, he will be a musaafir.

And Allah Ta’ala knows best.

السفر الذي يتغير به الأحكام أن يقصد الإنسان مسيرة ثلاثة أيام ولياليها بسير الإبل ومشي الأقدام لقوله عليه الصلاة والسلام يمسح المقيم كمال يوم وليلة والمسافر ثلاثة أيام ولياليها عمت الرخصة الجنس ومن ضرورته عموم التقدير وقدر أبو يوسف رحمه الله بيومين وأكثر اليوم الثالث والشافعي بيوم وليلة في قول وكفى بالسنة حجة عليهما والسير المذكور هو الوسط وعن أبي حنيفة رحمه الله التقدير بالمراحل وهو قريب من الأول ولا معتبر بالفراسخ هو الصحيح ولا يعتبر السير في الماء معناه لا يعتبر به السير في البر فأما المعتبر في البحر فما يليق بحاله كما في الجبل (هداية 1/165)
