Paying Zakah to one`s Father

Answered as per Shafi'i Fiqh by Darul Iftaa Jordan
Is it permissible that I pay the Zakah of my wealth to my father in order for him to pay the tuition fees of my brother? It is worth pointing that I am married and have other financial obligations.

Answer:

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

It isn`t permissible to give one`s father from the Zakah under the excuse that he is poor or needy, because if he is then providing for him (father) is an obligation on his children. However, it is permissible to give him from the Zakah if he is a debtor and can`t afford to pay off his debts. However, we recommend that you (Questioner) give your brother from the Zakah of your wealth directly in case he can`t afford the tuition fees since this is permissible if he is hardworking and god-fearing student. And Allah the Almighty knows best.
