Is It Permissible to Perform Hajj With a Group That Has Tents in the Extension of the Mina Area? (Shafi’i)

Question: Assalam alaykum,

Is it permissible to perform hajj with a group that has tents in the extension of the Mina area?

Answer: Wa alaikum assalam wa rahmatullah,

It is permissible to perform hajj with a group that has tents in the extension of the Mina area, at least part of which falls outside the original boundary of Mina, and is in Muzdalifa proper. A person’s hajj would remain valid in the school because staying in Mina for most of the night during the days of Tashriq is not an integral (rukn) of hajj.

It is rather considered an obligatory aspect (wajib) of hajj. This means that, like other obligatory aspects of hajj, one would be responsible for an expiation for its non-performance, even though the hajj itself would remain legally valid.
