Personal Use of Mosque Property

Assalamualaikum Warahmatullah

The mosque in my locality has 4 trash containers for its use. The bill is paid by the mosque to the trash service. The ameer of the mosque has allowed one of the trash containers to be used by one of his friends (for his personal use). This friend lives across the street from the mosque. The person keeps the trash container at his property and brings it to mosque every week on trash pickup day and after trash pickup takes it back to his property. The ameer of mosque says he will pay the cost of one container on behalf of his friend. When asked from the ameer if he will allow someone else to do the same, his answer was ‘no’. Is it permissible for the ameer to allow his friend to use a trash can from the mosque for his personal use?

Assalamualaikum Warahmatullah

It is impermissible for the ameer sahib to give the trash cans from the mosque for his friend’s personal use. (Fatawah Mahmoodia, Pg.264, Vol.14)

ما في ’’ الفتاوی الہندیۃ ‘‘ : متولي المسجد لیس لہ أن یحمل سراج المسجد إلی بیتہ ۔،(فتاوی عالمگیر :ج۲،ص ۴۶۲)

ولا تجوز إعارۃ الوقف والإسکان فیہ ۔ کذا في محیط السرخسي ۔

ما في ’’ التنویر مع الدر والرد ‘‘ : فإذا تم ولزم لا یَملِک ولا یُمَلَّک ولا یعار ولا یرہن ۔
