Marriage Argument

Assalamualaikum,

A couple days ago I had an argument with my wife and she threatened that she will go to her mom’s or go somewhere else and said that she can’t live here and left the room. After a couple of minutes she came back into the room and started arguing and I got angry with her and said okay leave, pack your bags and leave. I also later said, ” I’m done with you” but I can’t be sure that what I meant is that I’m done with her behavior and how she has been acting. Not once during the fight did my mind go towards divorce. Somewhere in the argument I also remember saying the Urdu word “khatam” but I cannot remember in what context this word was used. What is the status of our nikkah? I do not want divorce at all and my reaction and words was all anger. 

الجواب وباللہ التوفیق

Per situation described in the question because your intention was not of giving divorce, therefore, the divorce will not take effect.

الکنایات لا تطلق بہا إلا بنیۃ، أو دلالۃ الحال، فنحو اخرجي، واذہبي، وقومي۔(تنویر الأبصار مع الدر المختار والشامي، کراچي ۳/۲۹۷)

وأما الضرب الثاني وہو الکنایات لا یقع بہا الطلاق إلا بالنیۃ أو بدلالۃ الحال؛ لأنہا غیر موضوعۃ لطلاق؛ بل تحتمل وغیرہ فلا بد من التعیین أو دلالتہ۔ (الہدایۃ / فصل في الطلاق قبل الدخول ۲؍۳۸۹ مکتبۃ بلال دیوبند)

والقول قول الزوج في ترک النیۃ مع الیمین في باب الکنایات۔ (الفتاویٰ الہندیۃ :۱؍۳۷۵)
