Money Gifted Specifically for Minor Kids

Answered as per Hanafi Fiqh by ShariahBoard.org

Assalamualaikum

I have minor kids and people sometimes gives money as gifts and says use it for the kids, so do I have to use every single $ for the kids ? If so what is the best way to use it for the kids, and if there is two kids do I have to use the money equally for both of them?  Jazakallah hu kairan.

If the money gifted is specifically for the children, then it will be considered the children’s property, the parents will not have a right to utilize it for themselves. However, it will be permissible for the parents to utilize this money for fulfilling the children’s needs. If however, the parents are in dire need, then there is gunjaish (i.e. a provision for permissibility) for them to use this money.

If the person gifting that money specified one specific child, then it will be considered that particular child’s property. If there was no such specification, then the total amount should be equally divided among the total number of children. If there is a need for the children which can be fulfilled with this money, the parents should use it for that purpose. Otherwise, once the children are baligh, it should be handed to them with hikmah.
