Inheritance from Deceased Grand Parents

Answered as per Hanafi Fiqh by ShariahBoard.org

Assalamulaiakum Respected Ulemaa,

My paternal grandfather passed away when my father was alive. At the time of my paternal grandfather’s death, no inheritence was divided. My father passed away without receiving any inheritence during his lifetime. My paternal grandmother passed away after my father and no inheritence was divided. I would like to know, what is the rightful inheritence according to Islam for myself, my mother, and my brother and 2 sisters?

I am the eldest son of my deceased father, I have one brother and two sisters. And my mother is also alive. My deceased father has 3 sisters who are alive and each of them also have children. Please explain clearly what is each of our rightful share of inheritence in this circumstance.

JazakAllah Khair

This issue is related to manaskha, therefore, we reccomend that if convenient please contact a local darul-ifta, which will be better in this situation. Furhtermore, please clarify to the darul-ifta the details of all the heirs present at the time of the death of the deceased (your grandfather and your father) so the inheritance could be distributed correctly.

Wassalam
