The Fiqh of Kissing While Fasting

Please could you clarify if kissing one’s partner constitutes the fast breaking. I have heard that in instances where saliva is exchanged while kissing, this nullifies the fast.

Assalamu alaykum

In general, kissing one’s partner while fasting is prohibitively disliked (makruh tahriman) and sinful if one is unsure whether such a kiss would lead to ejaculation or intercourse.

If one feels sure that it will not lead to anything else then it is in itself permitted.

Should one kiss one’s partner in a way termed as ‘passionate kiss’ (taqbil fahish) whereby he sucks her lips or grips one of them with his teeth then this is disliked regardless of whether he expects it to lead to anything further or not. Should one be certain of swallowing one’s spouse’s saliva then this would break the fast and would also necessitate an expiation. [ibid, 2:331]
