Can a separated woman go to Hajj with her brother without her husband’s permission?

Assalamu Alaykum,

I am a woman who has been separated from my husband over 9 months now, still does not give my divorce. I will to go to hajj this coming December but I am wondering if it is permissible for me to go with my brother without needing my husband permission as I have no contract with him.
Some say my hajj won’t be accepted without asking him, others say I need to be divorce then go. But I really will like to know your opinion!! This Is very Urgent As I am Going To Book My Ticket SOON

You must first obtain a divorce (Talaq) or a seperation decree (Faskh) then you must remain at home during I’dda and cannot make Hajj whether the Hajj is Fardh, Nazar (vowed) or Nafl (optional).
