Can a Divorced Couple Reconcile After Acting in Anger and Unexpected Pregnancy?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: When a couple get divorced in anger and say its final but then for two reasons want to reconcile, can they? Firstly, they feel they did this in anger and secondly she discovers she is pregnant. Can they reconcile?

Bismillaah

A: The talaaq issued in anger is valid. If three talaaqs were issued, then the nikaah has terminated. It will be totally haraam for them to continue living together as husband and wife.

And Allah Ta’ala (الله تعالى) knows best.

Q: But what about the pregnancy that has been discovered thereafter?

Bismillaah

A: The wife being pregnant will not prevent the talaaq from taking place.

And Allah Ta’ala (الله تعالى) knows best.
