The Shar’i Ruling on Iddat for Women with Irregular Menstruation

Q: What is the Shar’i ruling regarding a lady who is sitting in iddat and after experiencing one haidh, eight months have passed and she did not experience a second haidh. How long more must she wait until she completes her iddat?

A: According to the Hanafi mazhab, the iddat period of such a woman will be three complete haidh (menstrual cycles). On the completion of three haidh her iddat period will terminate. Nevertheless, if she did not experience haidh till she reaches the age of 55, then she will calculate three months from that time and upon the completion of three months her iddat will be complete.

However, since practising upon this verdict is extremely difficult, the Hanafi jurists have allowed in this situation that the fatwa be issued upon the verdict of the Maaliki mazhab. The Maaliki mazhab in this masala is as follows:

If a woman sitting in iddat experienced the first haidh and thereafter she no longer experiences bleeding then she will have to wait for a period 9 months. If during the 9 months she does not experience haidh, she will sit for an additional three months and upon the completion of the three months she will come out of the iddat. However, if during the three months she experiences haidh then she will have to calculate her iddat in accordance to haidh. Hence upon the completion of three tuhr she will come out of iddat. قلت ونظير هذه المسألة عدة ممتدة إلى الطهر التي بلغت برؤية الدم ثلاثة أيام ثم امتد طهرها فإنها تبقى في العدة إلى أن تحيض ثلاث حيض وعند مالك تنقضي عدتها بتسعة أشهر وقد قال في البزازية الفتوى في زماننا على قول مالك وقال الزاهدي كان بعض أصحابنا يفتون به للضرورة واعترضه في النهر وغيره بأنه لا داعي إلى الإفتاء بمذهب الغير لإمكان الترافع إلى مالكي يحكم بمذهبه وعلى ذلك مشى ابن وهبان في منظومته هناك لكن قدمنا أن الكلام عند تحقق الضرورة حيث لم يوجد مالكي يحكم به (رد المحتار 4/ 296)

(وإن لم تميز) المستحاضة المطلقة بين الدمين (أو تأخر) حيض المطلقة (بلا سبب) أصلا (أو) بسبب أنها (مرضت) قبل الطلاق أو بعده فانقطع حيضها (تربصت) في هذه المسائل الثلاثة (تسعة) من الاشهر استبراء لزوال الريبة لانها مدة الحمل غالبا (ثم اعتدت بثلاثة) وحلت بعد السنة حرة أو أمة (حاشية الدسوقي 2/ 469)

وأما التي تطلق فلا تحيض وهي في سن الحيض وليس هناك ريبة حمل ولا سبب من رضاع ولا مرض فإنها تنتظر عند مالك تسعة أشهر فإن لم تحض فيهن اعتدت بثلاثة أشهر فإن حاضت قبل أن تستكمل الثلاثة الأشهر اعتبرت الحيض واستقبلت انتظاره فإن مر بها تسعة أشهر قبل أن تحيض الثانية اعتدت ثلاثة أشهر فإن حاضت قبل أن تستكمل الثلاثة أشهر من العام الثاني انتظرت الحيضة الثالثة فإن مر بها تسعة أشهر قبل أن تحيض اعتدت ثلاثة أشهر فإن حاضت الثالثة في الثلاثة الأشهر كانت قد استكملت عدة الحيض وتمت عدتها ولزوجها عليها الرجعة ما لم تحل (بداية المجتهد 4/ 403)
