Remaining silent during Salaah for such a period where one can recite three “Subhan Allah”

Q: In the Hanafi madhab, if you remain silent (during prayer) for a time period where one can recite “Subhan Allah” 3 times, then it becomes waajib for the person to perform Sajdah Sahw. If, however, the individual did not perform Sajdah Sahw, does he then have to repeat his prayer? What if, in the past, the person did not pay attention to this fact during his prayer, and he now has several prayers where he was required to perform Sajdah Sahw, but he did not do so. Does he have to repeat all those prayers?

A: It is waajib to repeat the namaaz as long as the time of that namaaz remains. Once the time passes, it no longer remains waajib.

( يجب بعد سلام واحد عن يمينه فقط ) . . . ( سجدتان و ) … ( تشهد وسلام ) . . .  ( إذا كان الوقت صالحا ) . . . ( بترك ) متعلق بيجب ( واجب ) مما مر في صفة الصلاة ( سهوا ) فلا سجود في العمد . . . ( وإن تكرر ) لأن تكراره غير مشروع ( كركوع ) متعلق بترك واجب ( قبل قراءة ) الواجب لوجوب تقديمها

قال الشامي : قوله ( بترك واجب ) أي من واجبات الصلاة الأصلية لا كل واجب إذ لو ترك ترتيب السور لا يلزمه شيء مع كونه واجبا بحر (رد المحتار 2/ 80)

قوله ( وإعادتها بتركه عمدا ) أي ما دام الوقت باقيا وكذا في السهو ان لم يسجد له وإن لم يعدها حتى خرج الوقت تسقط مع النقصان وكراهة التحريم ويكون فاسقا آثما وكذا الحكم في كل صلاة أديت مع كراهة التحريم (حاشية الطحطاوي على مراقي الفلاح ص 247)

Q: What about Qada prayers performed, where the person was required to perform Sajdah Sahw, but did not do so?

A: The fardh will be discharged. However, you should not repeat the mistake in future.
