Property Distribution: How to Divide Rs 50 Lac Among Family Members

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I have a question regarding property distribution. My father wants to know what should be the shares given to his children from his property worth Rs 50 Lac. I want to know how the above said property shud be distributed between My mother, My bhabi (my brother died 10 years back and stays with her mother), My sister, My bhatigi (only daughter of my late brother) and myself (only son now). Please mention the distribution share and percentage and also please mention if there is any hadith or verse which tells about the kind of property share to be distributed.

A: If these are the only relatives at the time of your father’s demise, then your father’s property will be divided into 24 equal shares and distributed as follows:

Wife will receive 3 shares

Son will receive 14 shares

Daughter will receive 7 shares

Your nephew and your late brother’s wife will not inherit.

And Allah Ta’ala (الله تعالى) knows best.
