Inheriting Property: Islamic Guidelines for Family Distribution

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I have question regarding property distribution.

My father owns a house worth Rs 50 Lac.

I have contributed for about 6-7 Lacs in it.

I want to know how the above said property is distributed between:

My father, My mother, My bhabi ( my brother died 10 yrs back), My sister, My bhatigi (only daughter of my late brother) and myself (only son) now. Please mention the distribution share and percentage and also please mention if there is any hadith or verse which tells about the kind of property share to be distributed.

A: You need to define whose property it is. If it is the father’s property and he wishes to make it over as a gift to his children etc. then he may do so. Preferably if he is giving it to his children then he should give them equal shares.

And Allah Ta’ala (الله تعالى) knows best.
