Q: A revert is asked by his wife for a divorce, which he refuses. She applies for a court interdict after they have a fight and his Muslim lawyer advises him to agree to the divorce in exchange for the wife not asking for the interdict. He reluctantly agrees but still doesn’t give talaaq. A few weeks later his lawyer says that the wife is waiting for the talaaq and he must give it. He writes “I hereby give you a divorce” and the lawyer adds “in this regard I give you 3 talaaq.” He signs it and the lawyer emails it to the wife. What is the validity of this divorce and is it 3 or 1? The husband says he has never wanted the divorce and it was never his intention to give 3 as he did not understand what this meant.
A: Since he has signed for all three talaaqs, three have taken effect.
قال في الهندية الكتابة على نوعين مرسومة وغير مرسومة ونعني بالمرسومة أن يكون مصدرا ومعنونا مثل ما يكتب إلى الغائب وغير المرسومة أن لا يكون مصدرا ومعنونا وهو على وجهين مستبينة وغير مستبينة فالمستبينة ما يكتب على الصحيفة والحائط والأرض على وجه يمكن فهمه وقراءته وغير المستبينة ما يكتب على الهواء والماء وشيء لا يمكن فهمه وقراءته ففي غير المستبينة لا يقع الطلاق وإن نوى وإن كانت مستبينة لكنها غير مرسومة إن نوى الطلاق يقع وإلا لا وإن كانت مرسومة يقع الطلاق نوى أو لم ينو
ثم المرسومة لا تخلو أما إن أرسل الطلاق بأن كتب أما بعد فأنت طالق فكما كتب هذا يقع الطلاق وتلزمها العدة من وقت الكتابة وإن علق طلاقها بمجيء الكتاب بأن كتب إذا جاءك كتابي فأنت طالق فجاءها الكتاب فقرأته أو لم تقرأ يقع الطلاق كذا في الخلاصة (رد المحتار 3/246)
فروع كتب الطلاق إن مستبينا على نحو لوح وقع إن نوى وقيل مطلقا ولو على نحو الماء فلا مطلقا ولو كتب على وجه الرسالة والخطاب كأن يكتب يا فلانة إذا أتاك كتابي هذا فأنت طالق طلقت بوصول الكتاب جوهرة (رد المحتار 3/ 246)
