Can a Father in Islamic Law Make Custody Conditional on His Wife’s Remarriage?

Q: I wish to know as to whether a father who is entitle to custody in terms of Islamic Law of his children girls ages 15 and 13 respectively can make a following condition as his wife who wants to divorce him and refuses to give him custody of the children. The condition being that should she remarry the custody of the children shall revert to him?

A: After the age of 9 the custody of the children (if it is a girl) moves away from the mother to the father. Hence such conditions are baseless and invalid. Whether the wife remarries or not, the husband has the right of the custody of his children.

( والحاضنة ) أما أو غيرها ( أحق به ) أي بالغلام حتى يستغني عن النساء وقدر بسبع وبه يفتى لأنه الغالب … ( والأم والجدة ) لأم أو لأب ( أحق بها ) بالصغيرة ( حتى تحيض ) أي تبلغ في ظاهر الرواية … ( وغيرهما أحق بها حتى تشتهي ) وقدر بتسع وبه يفتى … ( وعن محمد أن الحكم في الأم والجدة كذلك ) وبه يفتى لكثرة الفساد زيلعي

و قال في الشامية : قوله ( في ظاهر الرواية ) مقابله رواية محمد الآتية, قوله ( وبه يفتى ) قال في البحر بعد نقل تصحيحه ولحاصل أن الفتوى على خلاف ظاهر الرواية ( رد المحتار 3/566)
