Adopted Child with Unknown Real Parents: Shar’ee Ruling?

Q: A certain child was adopted by foster parents according to the legal procedure and registered under the foster parents name. The foster and real parents don’t know each another’s identity. The child is now 3 years old. What is the Shar’ee ruling in this case?

A: This child is a yateem (orphan). He should not be counted as the son of the foster parents since this is misleading.

ادعوهُم لِابائِهِم هُوَ أَقسَطُ عِندَ اللَّهِ فَإِن لَم تَعلَموا ءاباءَهُم فَإِخوٰنُكُم فِى الدّينِ وَمَوٰليكُم وَلَيسَ عَلَيكُم جُناحٌ فيما أَخطَأتُم بِهِ وَلكِن ما تَعَمَّدَت قُلوبُكُم وَكانَ اللَّهُ غَفورًا رَحيمًا ﴿٥﴾

خطبنا علي بن أبي طالب فقال من زعم ان عندنا شيئا نقرؤه إلا كتاب الله وهذه الصحيفة قال وصحيفة معلقة في قراب سيفه فقد كذب فيها أسنان الإبل وأشياء من الجراحات وفيها قال النبي صلى الله عليه وسلم المدينة حرم ما بين عير إلى ثور فمن أحدث فيها حدثا أو آوى محدثا فعليه لعنة الله والملائكة والناس أجمعين لا يقبل الله منه يوم القيامة صرفا ولا عدلا وذمة المسلمين واحدة يسعى بها أدناهم ومن ادعى إلى غير أبيه أو انتمى إلى غير مواليه فعليه لعنة الله والملائكة والناس أجمعين لا يقبل الله منه يوم القيامة صرفا ولا عدلا (صحيح مسلم رقم 1370)
