Facilitating Euro Purchases with Dated Cheques: Is it Riba?

Q:

  1. I have a friend that does business with me. He buys euros from me. Usually he buys euros and although my rate is higher he buys from me because I give him facilities in time to pay. For example I sell him 20 000e at 13 Rand equal to 260 000 rands and he pays in 5 months cheques in Rands.
  2. Today another situation came up as he wants to buy 40 000e equal to R520 000 paid in cheques also and although I gave him 40 000e I know he will change again into rand as he is buying a shop so he needs rands. Although I know he will change again in to rands is it riba or Its not my problem since I am giving him in euros?
  3. My rate is higher he buys from me because I give him facilities. Dated cheques 4 to 5 to 6 months in time to pay for it. Is this riba as he can buy next to him cheaper but no facilities  has to be cash. With me higher rate but dated cheques as I trust him. Is that riba?
  4. Sometimes he buys from me euros. He gives me rands and  dated cheques of course and since he lives in 300km from my city  and next to him there is a guy that sells euros. So I give him the amount to buy euros there on my behalf and pay his supplier is that correct?
  5. What if I give the rands to buy euros there on my behalf and he does not buy but instead keeps the rands for other transactions ? Is that my responsibility?

Bismillaah

A: Since the exchange rates are confirmed from the inception of the transaction and are not subject to any type of fluctuation this type of transaction is permissible. At least one exchange should be received, be it the rand or the euros; one of the two has to be received for the transaction to be correct. If you have allowed him to use your money and replace it with the exact amount then it is permissible.


Q: What about facilities of payment?

A: You should ensure that: (1) one side of the payment is complete; either, the euros or the rands. (2) Determine the exact amount that is going to be received in exchange.

If you want to help him then you may help him without any gain and with the freedom that he can use the money as he wants and return the principle amount.

قال ويجوز بيع الفلس بالفلسين بأعيانهما عند أبي حنيفة وأبي يوسف رحمهما الله وقال محمد لا يجوز لأن الثمنية تثبت باصطلاح الكل فلا تبطل باصطلاحهما وإذا بقيت أثمانا لا تتعين فصار كما إذا كانا بغير أعيانهما وكبيع الدرهم بالدرهمين ولهما أن الثمنية في حقهما تثبت باصطلاحهما إذ لا ولاية للغير عليهما فتبطل باصطلاحهما وإذا بطلت الثمنية تتعين بالتعيين ولا يعود وزنيا لبقاء الاصطلاح على العد إذ في نقضه في حق العد فساد العقد فصار كالجوزة بالجوزتين بخلاف النقود لأنها للثمنية خلقة وبخلاف ما إذا كانا بغير أعيانهما لأنه كالىء بالكالىء وقد نهى عنه وبخلاف ما إذا كان أحدهما بغير عينه لأن الجنس بانفراده يحرم النساء (الهداية 3/ 81)

قال وإذا عدم الوصفان الجنس والمعنى المضموم إليه حل التفاضل والنساء لعدم العلة المحرمة  والأصل فيه الإباحة وإذا وجدا حرم التفاضل والنساء لوجود العلة وإذا وجد أحدهما وعدم الآخر حل التفاضل وحرم النساء مثل أن يسلم هروبا في هروي أو حنطة في شعير فحرمة ربا الفضل بالوصفين وحرمة النساء بأحدهما وقال الشافعي الجنس بانفراده لا يحرم النساء لأن بالنقدية وعدمها لا يثبت إلا شبهة الفضل وحقيقة الفضل غير مانع فيه حتى يجوز بيع الواحد بالاثنين فالشبهة أولى ولنا أنه مال الربا من وجه نظرا إلى القدر أو الجنس والنقدية أوجبت فضلا في المالية فتتحقق شبهة الربا وهي مانعة كالحقيقة إلا أنه إذا أسلم النقود في الزعفران ونحوه يجوز وإن جمعهما الوزن لأنهما لا يتفقان في صفة الوزن فإن الزعفران يوزن بالأمناء وهو مثمن يتعين بالتعيين والنقود توزن بالسنجات وهو ثمن لا يتعين بالتعيين ولو باع بالنقود موازنة وقبضها صح التصرف فيها قبل الوزن وفي الزعفران وأشباهه لايجوز فإذا اختلفا فيه صورة ومعنى وحكما لم يجمعهما القدر من كل وجه فتنزل الشبهة فيه إلى شبهة الشبهة وهي غير معتبرة (الهداية 3/ 79)
