Shar’i requirements for the validity of Nikah

Q: What are the Shar’i requirements for the validity of Nikah?

Bismillaah

A: It is a condition for the Nikah to be valid that the proposal and acceptance take place between the bride and bridegroom or their representatives in the presence of two Muslim baaligh male witnesses or one Muslim baaligh male witness and two Muslim baaligh female witnesses.

ويندب إعلانه وتقديم خطبة وكونه في مسجد يوم جمعة بعاقد رشيد وشهود عدول… ( وينعقد ) ملتبسا ( بإيجاب ) من أحدهما ( وقبول ) من الآخر… ومن شرائط الإيجاب القبول اتحاد المجلس لو حاضرين… ( وشرط سماع كل من العاقدين لفظ الآخر ) ليتحقق رضاهما ( و ) شرط ( حضور ) شاهدين ( حرين ) أو حر وحرتين ( مكلفين سامعين قولهما معا ) على الأصح (الدر المختار 3/8-23)
