Insuring an Item with the Courier Company

Q: A courier company company offers it’s services for a certain amount (e.g. R50). However, they state if you wish to have to item insured then the charge is so much more (e.g. R50 more – total R100 if you want it insured). We are unaware if they are insuring with a third party. Is it permissible to take this insurance?

A: If the courier company charges you one price (R100) for transporting the goods and they of their own insure the goods it will be permissible.

يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا الرِّبَا أَضْعَافًا مُّضَاعَفَةً وَاتَّقُوا اللَّـهَ لَعَلَّكُمْ تُفْلِحُونَ ﴿١٣٠﴾ (سورة آل عمران الآية 130)

( ولا يستحق المشترك الأجر حتى يعمل كالقصار ونحوه ) كفتال وحمال و قال في رد المحتار : قوله ( حتى يعمل ) لأن الإجارة عقد معاوضة فتقتضي المساواة بينهما فما لم يسلم المعقود عليه للمستأجر لا يسلم له العوض والمعقود عليه هو العمل أو أثره على ما بينا فلا بد من العمل … وما لا أثر له كحمال له الأجر كما فرغ وإن لم يسلم (رد المحتار 6/64)
