Paying the Zakaat of a Waived Debt for the Previous Years

Q: If the creditor waived off the debt, then will zakaat be waajib on the previous years?

A: If the creditor waives off the debt of a poor person, then zakaat will no longer be waajib upon the debt, neither for the current year nor for the previous years. However, if the creditor waives off the debt of a wealthy person, zakaat will not be waajib for the current year (provided it is before the zakaat date). But zakaat will be waajib for the previous years.

ولو أبرأ رب الدين المديون بعد الحول فلا زكاة سواء كان الدين قويا أو لاخانية وقيده في المحيط بالمعسر أما الموسر فهو استهلاك فليحفظ بحر قال في النهر وهذا ظاهر في أنه تقييد للإطلاق وهو غير صحيح في الضعيف كما لا يخفى (شامي 2/307)
